1. About the Website
Welcome to https://adcprep.com/ https://www.lavanika.academy (the ‘Website’). The Website is operated by Lavanika Academy Pty Ltd (ACN 663 950 605) (‘we’, ‘our’, or ‘us’). The Website provides information on dental exam coaching and preparation services (the ‘Services’).
Please read these Terms and Conditions (‘Terms’) carefully. By using, browsing, or reading the Website, you signify that you have read, understood, and agree to be bound by the Terms. If you do not agree with the Terms, you must cease use of the Website and Services immediately.
We reserve the right to update these Terms at any time by publishing the revised version on this page. We will use reasonable endeavours to notify you of material changes. The version of the Terms displayed at the time of your purchase applies to that purchase. We recommend you keep a copy of the Terms for your records.
Content on this Website is provided for general information purposes. We do not undertake to keep the Website up-to-date and we are not liable if any content is inaccurate or out-of-date.
2. Acceptance of Terms
By remaining on the Website, enrolling in a course, or purchasing any Service, you accept these Terms and enter into a binding agreement with Lavanika Academy Pty Ltd. These Terms govern your use of adcprep.com www.lavanika.academy and your purchase of any course, coaching, mock exam, live training, digital content, or study materials (‘Services’).
You may not use the Services if:
- you are not of legal age to form a binding contract; or
- you are barred from receiving the Services under the laws of Australia or other countries, including the country in which you reside or from which you use the Services.
3. Registration and Subscription
To access the Services, you must purchase a course through the Website (the ‘Subscription’) and pay the applicable fee (the ‘Subscription Fee’).
In purchasing a Subscription, you acknowledge and agree that it is your responsibility to ensure the Subscription you elect to purchase is suitable for your use and your circumstances, including your ADC exam timeline.
Once you have purchased a Subscription, you may be required to provide the following to complete registration:
- Gmail email address
- Phone number
- Preferred name
You warrant that all information provided during registration is accurate, correct, and up-to-date. You are responsible for maintaining the confidentiality of your login credentials. Use of your credentials by any other person may result in immediate suspension of access.
Once registration is complete, you will be a registered member (‘Member’) and granted access to the Services for the duration of the Subscription Period as set out in Clause 4 below.
4. Access Period
Access to study materials and digital content is provided for 12 months from the date Materials are first made available to you, or until you pass the part of the ADC examination the course prepares you for — Part 1 or Part 2 — whichever occurs first (‘Access Period’).
The purpose of the Materials is exam preparation, so access ends once that purpose is met. Each course prepares you for one part of the ADC examination — Part 1 (the Written Examination) or Part 2 (the Practical Examination) — and access to that course’s Materials ends when you pass that part in full. Passing an individual station or task within a part does not end access; the part must be passed in full.
Enrolling later in a course for the other part is a separate purchase, with its own Access Period under this clause.
You agree to notify us at info@lavanika.academy when you pass the relevant part, and we may end access on becoming aware that you have passed. If you pass and later need access again, contact us and we may reinstate or extend access, which may be offered as a separate paid service at our discretion.
Access may also be revoked after the 12-month period unless otherwise extended in writing by Lavanika Academy Pty Ltd. We may add or update features during the Access Period. Additional terms may apply to new features.
Where a course includes recent-changes updates (information about changes to ADC exam format, content, or focus areas), these updates are provided only during your Access Period. Once your Access Period ends, you are no longer entitled to receive such updates unless your access is extended in writing by Lavanika Academy Pty Ltd. Any extension of the Access Period, including continued receipt of recent-changes updates, may be offered as a separate paid service at our discretion.
5. Delivery of Materials
Materials may be delivered to you via one or more of the following methods:
- Google Drive
- Learning Management System (LMS) or portal login credentials
- Facebook group
- Downloadable links
Materials are considered ‘Delivered’ when any of the above access methods are issued to you, whether or not you have accessed or downloaded the Materials at that time.
For Onsite Courses: Delivery of the Service is considered to commence upon your arrival at the Academy for your first scheduled session.
We may contact you by phone, SMS, or email using the details you provide. This may include information about your enrolment, Services, and marketing communications (unless you opt out).
6. Fees and Payment
All fees are payable in full at the time of enrolment. All monetary amounts are expressed in Australian Dollars (AUD) and are inclusive of GST where applicable, unless otherwise stated.
Payment may be made by:
- Credit or debit card
- Stripe Inc. payment processing platform (‘Stripe’)
Where payment is processed via Stripe, you acknowledge that you have read and agree to Stripe’s terms and conditions, available on the Stripe website. We do not receive or store your credit or debit card details — all card information is processed securely by the payment processor.
If you wish to use an alternative payment method not listed above, please contact us at info@lavanika.academy. Any such request is at our sole discretion, and an administration fee may apply.
If a payment is returned, reversed, or otherwise unpaid for any reason, you remain liable for all associated fees and charges, and we may suspend access to your Materials until payment is received.
We reserve the right to vary the Subscription Fee at any time. Any varied fee takes effect from the date of the next Subscription Period.
7. Refund, Cancellation and Transfer Policy
ACL Note: Nothing in this clause limits or excludes your rights under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)). If our Services are faulty, not provided with due care and skill, or do not meet the consumer guarantees, your statutory rights apply regardless of the terms below.
7.1 Digital Courses and Study Materials
(a) Before Materials Are Delivered
If you cancel your enrolment before any Materials are Delivered (as defined in Clause 5) and before program commencement, you may request a refund. A 10% administrative fee plus any applicable, non-refundable payment processing costs (e.g., Stripe transaction fees) will be deducted from the refund amount.
(b) After Materials Are Delivered — Grace Period
If Materials have been Delivered but you have not accessed them, and you notify us in writing within 48 hours of the delivery notification, a refund less the 10% administrative fee and processing costs may be considered at our discretion.
(c) After Materials Are Accessed or Grace Period Has Passed
Once Materials have been accessed by you, or 48 hours have passed since delivery (whichever occurs first), no change-of-mind refund is available, even if:
- the batch or program has not yet commenced;
- your ADC exam date has changed; or
- your personal or professional circumstances have changed.
This policy reflects that delivery of Materials represents fulfilment of a substantial part of our Services and involves real costs to the Academy.
Your statutory rights under the Australian Consumer Law are not affected by this clause. If Materials are not accessible or are not of acceptable quality, please contact us immediately at info@lavanika.academy.
(d) After Commencement of Live or Structured Sessions
Once live sessions, role plays, structured classes, or coaching sessions have commenced, no change-of-mind refund is available.
This does not affect your right to a remedy if sessions are not delivered as described or do not meet the consumer guarantees under the Australian Consumer Law.
7.2 Onsite Courses — Skilled OSCE, Technical Skills, and Mock Exams
Due to the strictly limited intake (maximum 6 participants per cohort) and upfront committed costs including faculty fees, equipment, and consumables, the following cancellation fee schedule applies. These fees represent a genuine pre-estimate of the losses incurred by the Academy when a participant cancels.
| Program Type | Time Before Start | Retained Fee | Notes |
|---|---|---|---|
| Skilled OSCE Course (half-day) | More than 30 days | 15% | |
| 14 – 30 days | 40% | ||
| Less than 14 days | 100% | See note (a) | |
| Technical Skills Course (10 days) | More than 45 days | 20% | |
| 21 – 45 days | 50% | ||
| Less than 21 days | 100% | See note (a) | |
| Mock Exams | More than 21 days | 15% | |
| 7 – 21 days | 40% | ||
| Less than 7 days | 100% | See note (a) |
Note (a) — 100% Retention and Mitigation: Where a cancellation occurs within the 100% retention period, we will use reasonable endeavours to fill the vacated seat from our waitlist. If the seat is successfully filled, a partial refund less actual administrative and sunk costs may be offered at our discretion. We will notify you within 5 business days of the program date whether the seat has been filled.
All time periods in this clause refer to calendar days. The relevant date is the date written notice of cancellation is received by us at info@lavanika.academy.
Your statutory rights under the Australian Consumer Law are not affected by this cancellation schedule. If we fail to deliver the Services as described, you retain your full rights to a remedy regardless of the above.
7.3 Transfers
You may request one transfer to a different program batch, subject to the following conditions:
- For onsite courses, transfer requests must be made at least 14 calendar days before the program commencement date.
- For mock exams, transfer requests must be made at least 7 calendar days before the commencement date.
- Transfers are subject to seat availability in the requested batch.
- An administrative transfer fee of up to $50 AUD may apply.
- Transfers are not guaranteed and are granted at the discretion of Lavanika Academy Pty Ltd.
- A second transfer request may be considered at our discretion and may attract an additional fee.
7.4 If We Cancel or Cannot Deliver
If Lavanika Academy Pty Ltd cancels a program or is unable to deliver the Services as described, you will be entitled to your choice of:
- a full reschedule to an equivalent program at no additional cost;
- a credit for the full amount paid, valid for 12 months; or
- a full refund of the amount paid.
We will process your chosen remedy within 10 business days of notifying you of the cancellation. This clause applies in addition to, and does not limit, your rights under the Australian Consumer Law.
7.5 Your Statutory Rights Under Australian Consumer Law
Nothing in this Clause 7 excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or other mandatory consumer protection legislation, including your right to a remedy where a service fails to meet a consumer guarantee. Your statutory rights apply regardless of any change-of-mind or cancellation policy set out above.
8. Your Obligations as a Member
As a Member, you agree to:
- use the Services only for lawful purposes and in accordance with these Terms;
- comply with all applicable laws and regulations;
- protect the confidentiality of your login credentials and not share them with any third party;
- notify us immediately at info@lavanika.academy if you become aware of any unauthorised use of your account;
- not use the Services in connection with any commercial endeavour unless expressly approved by us in writing;
- not engage in any automated use of the Website or Services; and
- not collect or harvest personal information of other Members from the Website.
9. Intellectual Property
All Materials, content, and related products provided through the Website and Services are owned by or licensed to Lavanika Academy Pty Ltd and are protected by copyright under Australian law and international treaties.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Materials during your Subscription Period for your own personal study purposes only.
You must not, without our prior written permission:
- share, distribute, upload, or provide access to Materials to any third party;
- reproduce, copy, record, or screenshot Materials;
- resell or commercially exploit Materials in any form;
- broadcast, publicly display, or publish Materials;
- modify or create derivative works from the Materials; or
- share your login credentials to allow multiple individuals to access the Services under a single Subscription.
Breach of these obligations may result in immediate termination of your access without refund and may expose you to civil and/or criminal liability.
You irrevocably grant us a perpetual, royalty-free licence to use any feedback you provide to us and any contributions you make during delivery of our Services, for our internal business development and for use within future content or Services.
10. User Content
You may submit feedback, comments, or content (‘User Content’) through our Website or related platforms. By doing so, you grant us a non-exclusive, royalty-free licence to use that User Content for the purpose of operating and improving our Services. You retain ownership of your User Content.
We will not sell or commercially exploit your User Content without your prior written consent.
You represent and warrant that:
- you own or have all necessary rights to the User Content you submit; and
- your User Content does not infringe any third party’s intellectual property rights, privacy rights, or applicable laws.
We do not endorse or approve User Content and may remove it at our sole discretion at any time.
11. Recordings and Use of Your Image
Sessions may be recorded by us using audio, video, or other means for quality assurance, training, and educational purposes. By participating in any session, you consent to being recorded.
Where you appear incidentally in a group recording or photograph (i.e., you are not the primary subject), you consent to us using such material for marketing and promotional purposes on our Website and social media channels.
By participating, you grant us permission to use incidental group recordings or photographs for marketing. You may opt-out of this marketing use by notifying us in writing at info@lavanika.academy prior to the commencement of your session.
We will seek your separate written consent before using your image or likeness as the primary subject in any marketing or promotional material.
12. Privacy
We take your privacy seriously. Any personal information collected through your use of the Website and Services is handled in accordance with our Privacy Policy, available at https://adcprep.com/privacy-policy/ and https://www.lavanika.academy/legal/privacy-policy. By using the Services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.
13. General Disclaimer
Use of the Website and Services is at your own risk. The Website and Services are provided on an ‘as is’ and ‘as available’ basis without warranty or condition of any kind, except as required by law.
To the extent permitted by law, we exclude all liability for:
- technical failures, interruptions, errors, or delays in delivering the Services;
- the accuracy, suitability, or currency of content on the Website;
- loss or damage arising from your use of or inability to use the Website or Services; and
- third-party content, links, or services referenced on the Website.
Nothing in this disclaimer limits or excludes any guarantees, warranties, or rights implied or imposed by the Australian Consumer Law or other legislation that cannot lawfully be excluded.
14. Limitation of Liability
To the maximum extent permitted by law, our total liability to you arising out of or in connection with the Services or these Terms — whether in contract, tort (including negligence), statute, or otherwise — is limited to the Subscription Fees paid by you for the relevant Service.
We are not liable for any indirect, incidental, special, or consequential loss or damage, including loss of profit, loss of business opportunity, or damage to goodwill, arising from your use of the Services.
Where legislation (including the Australian Consumer Law) implies a guarantee that cannot be excluded but can be limited, our liability for a failure to comply with that guarantee is limited to:
- in the case of services: re-supplying the services or paying the cost of having the services re-supplied; or
- in the case of goods: replacing, repairing, or paying the equivalent cost of the goods.
15. Indemnity
You agree to indemnify Lavanika Academy Pty Ltd against any reasonable costs, losses, and damages directly caused by:
- your deliberate breach of these Terms; or
- your unlawful conduct in connection with the use of the Website or Services.
This indemnity does not apply to any loss or damage caused or contributed to by the negligence or wrongful acts of Lavanika Academy Pty Ltd. It does not limit any rights you have under the Australian Consumer Law.
16. Termination
These Terms continue to apply until terminated by either party as set out below.
You may terminate your Subscription at any time by providing written notice to us via the Contact Us page. Termination is subject to the Refund and Cancellation Policy in Clause 7.
We may suspend or terminate your access immediately and without refund if you:
- breach any provision of these Terms, including by sharing or distributing Materials;
- engage in conduct that damages our reputation or the rights of another person; or
- are required to be terminated by law.
We may also terminate your Subscription if continued provision of the Services is no longer commercially viable, in which case Clause 7.5 applies.
Upon termination, all restrictions on your use of the Materials continue to apply, and you must cease using and destroy any copies of Materials in your possession.
17. Force Majeure
Neither party is liable for any delay or failure to perform their obligations under these Terms to the extent that such failure is caused by events beyond their reasonable control, including pandemics, natural disasters, acts of government, or infrastructure failures (‘Force Majeure Event’).
If we are unable to deliver the Services due to a Force Majeure Event, we will offer you rescheduling, credit, or a refund as appropriate to the circumstances. Nothing in this clause affects your rights under the Australian Consumer Law.
This clause does not excuse your obligation to pay Fees that are already due and payable.
18. Dispute Resolution
Notice
If a dispute arises in connection with these Terms, the party claiming the dispute (‘Dispute’) must give written notice to the other party specifying: the nature of the dispute, the desired outcome, and the action required to resolve it.
Negotiation
Within 28 days of the notice being received, the parties must endeavour in good faith to resolve the Dispute by negotiation or such other means as they may mutually agree.
Mediation
If the Dispute has not been resolved within 28 days of the notice, either party may request that a mediator be appointed by the President of the Victorian Small Business Commission (VSBC) or their nominee. The mediation will be held in Victoria, Australia. The parties share the mediator’s fees equally. Each party bears their own legal costs.
Court Proceedings
If the Dispute remains unresolved 30 days after mediation has commenced, either party may terminate the mediation and commence court proceedings.
Consumer Rights Preserved
Nothing in this dispute resolution clause prevents either party from lodging a complaint with the ACCC, a state consumer affairs body (including Consumer Affairs Victoria), VCAT, or any other applicable regulatory authority. Nothing prevents either party from seeking urgent interlocutory relief from a court.
Confidentiality
All communications made in the course of the dispute resolution process are confidential and are to be treated as ‘without prejudice’ negotiations for the purposes of applicable laws of evidence.
19. Governing Law and Jurisdiction
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria, Australia for the resolution of any dispute arising under these Terms.
Where you reside outside Australia, mandatory consumer protection laws in your country of residence may also apply to the extent required by those laws. Nothing in these Terms is intended to exclude or limit any rights you may have under those laws.
20. General Provisions
20.1 GST
Unless otherwise stated, all monetary amounts in these Terms are expressed in Australian dollars and are inclusive of GST where applicable.
20.2 Relationship of the Parties
Nothing in these Terms creates a partnership, joint venture, or employment relationship between you and Lavanika Academy Pty Ltd.
20.3 Assignment
You must not assign or novate these Terms or any rights under them without our prior written consent. We may assign or novate these Terms at our sole discretion.
20.4 Waiver
Any delay or failure by us to enforce any right under these Terms does not constitute a waiver of that right and does not prevent us from enforcing it at a later time.
20.5 Severance
If any provision of these Terms is found to be void, invalid, or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining Terms continue in full force and effect.
20.6 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lavanika Academy Pty Ltd with respect to your use of the Website and Services, and supersede all prior representations, agreements, or understandings.
20.7 Independent Legal Advice
Both parties confirm that the provisions of these Terms are fair and reasonable and that they have had the opportunity to obtain independent legal advice before agreeing to be bound by them.
